FOR TAKE OUT PRE-ORDERS, PRODUCTION OF THE ORDER WILL BEGIN AT LEAST 40 MINUTES BEFORE THE COLLECTION TIME, AFTER THIS IT WILL NOT BE POSSIBLE TO CANCEL OR MAKE AMENDMENTS TO YOUR ORDER. 

REFUNDS AND YOUR CONSUMER RIGHTS

IF YOU ARE ENTITLED TO A REFUND FOR ANY REASON, INCLUDING IF YOU HAVE BEEN ISSUED A REFUND FROM A MANAGER IF YOUR ORDER OR SERVICE RECIEVED WAS UNSATISFACTORY. A REFUND WILL BE ISSUED USING THE SAME MEANS OF PAYMENT AS YOU USED TO MAKE THE PAYMENT INITIALLY. 

THESE LEGAL RIGHTS ARE NOT AFFECTED BY ANYTHING IN THESE TERMS. 

TERMINATION

IT IS AT THE SOLE DISCRETION OF SMOKE & RYE TO TERMINATE THESE TERMS AT ANY TIME FOR ANY REASON WITHOUT NOTICE TO YOU BY DECOMMISSIONING THE SYSTEM. IF YOU DO NOT AGREE TO ANY AMENDED TERMS, YOU MUST IMMEDIATELY REQUEST THAT YOUR LOYALTY ACCOUNT IS DELETED AND STOP USING YOUR ACCOUNT. 

YOU MAY TERMINATE THESE TERMS AT ANY TIME FOR ANY REASON WITHOUT NOTICE TO SMOKE & RYE BY REMOVING YOUR LOYALTY ACCOUNT. 

OUR LIABILITY

SMOKE & RYE'S MAXIMUM LIABILITY TO YOU IN RELATION TO THESE TERMS WILL NOT SURPASS THE AMOUNT OF THE PURCHASE PRICE PAID BY YOU FOR ITEMS PURCHASED. WE ARE NOT RESPONSIBLE FOR ANY LOSS OR DAMAGE THAT IS NOT FORESEEABLE. LOSS OR DAMAGE IS FORESEEABLE IF IT IS AN OBVIOUS CONSEQUENCE OF OUR BREACH OF THESE TERMS OR IF IT WAS CONTEMPLATED BY YOU AND US AT THE TIME YOU PURCHASED THE ITEMS. THE RESTAURANT ONLY SUPPLIES MENU ITEMS AND PRODUCTS TO YOU FOR DEOMESTIC AND PRIVATE USE. YOU AGREE NOT TO USE THE ITEMS OR PRODUCTS FOR ANY COMMERICAL BUSINESS OR RESALE PURPOSES, AND WE HAVE NO LIABILITY TO YOU FOR ANY LOSS OF PROFIT, LOSS OF BUSINESS, BUSINESS INTERRUPTION, OR LOSS OF BUSINESS OPPORTUNITY. 

NOTHING IN THERE TERMS EXCLUDE LIBABILITY FOR DEATH OR PERSONAL INJURY CAUSED BY ITS NEGLIGENCE; FRAUD; OR ANY LIABILITY WHICH CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW. TO THE MAXIMUM EXTENT PREMITTED BY LAW, SMOKE & RYE EXCLUDES ALL OTHER WARRANTIES REPRESENTATIONS, CONDITIONS, AND TERMS, WHETHER EXPRESS OR IMPLIED, WRITTEN OR ORAL, TO THE FULLEST EXTENT PREMITTED BY THE LAW. 

YOUR LIABILITY

IF YOU FAIL TO COMPLY WITH THESE TERMS, YOU WILL BE RESPONSIBLE FOR ANY COSTS THAT WE INCUR AS A DIRECT RESULT OF YOUR FAILURE. IF WE DELAY OUR FAILURE TO ENFORCE OUR RIGHTS UNDER THESE TERMS AND CONDITIONS, THAT DOES NOT MEAN THAT WE LOSE THE RIGHT TO DO SO OR THAT YOU DO NOT HAVE TO COMPLY WITH YOUR OBLIGATIONS UNDER THES TERMS AND CONDITIONS. IF WE DO WAIVE A DEFAULT BY YOU, WE WILL ONLY DO SO IN WRITING, AND THAT WILL NOT MEAN THAT WE WILL AUTOMATICALLY WAIVE ANY LATER DEFAULT BY YOU.

LAW AND JURISDICTION

THESE TERMS ARE GOVERNED BY ENGLISH LAW. WHICH MEANS A CONTRACT FOR THE PURCHASE OF PRODUCTS THROUGH THE APP AND ANY DISPUTE OR CLAIM ARISING OUT OF OR IN CONNECTION WITH IT WILL BE GOVERNED BY ENGLISH LAW. YOU AND WE BOTH AGREE THAT THE COURTS OF ENGLAND AND WALES WILL HAVE NON-EXCLUSIVE JURISDICTION. 

EVENTS OUTSIDE OUR CONTROL

WE WILL NOT BE LIABLE OR RESPONSIBLE FOR FAILING OR DELAYING IN PERFORMING ANY OF OUR OBLIGATIONS UNDER THESE TERMS OR A CONTRACT BETWEEN YOU AND US IF THAT FAILURE OR DELAY IS CAUSED BY AN EVENT OUTSIDE OUR REASONABLE CONTROL. SUCH EVENT MAY INCLUDE, BUT IS NOT LIMITED TO: BREAKDOWN OF ESSENTIAL EQUIPMENT, LOSS OF POWER OR INTERNETM STRIKESM=, LOCK-OUTS OR OTHER INDUSTRIAL ACTION BY THRID PARTIES, CIVIL COMMOTION, RIOT, INVASION, TERRORIST ATTACK OR THREAT, WAR (WHETHER DECLARED OR NOT) OR THREAT OR PREPARATION FOR WAR, FIRE, EXPLOSION, STORM, FLOOD, EARTHQUAKE, SUBSIDENCE, EPIDEMIC OR OTHER NATURAL DISASTER, OR FAILURE OF PUBLIC OR PRIVATE TELECOMMUNICATIONS NETWORKS OR IMPOSSIBILITY OF THE USE OF RAILWAYS, SHIPPING, AIRCRAFT, MOTOR TRANSPORT OR OTHER MEANS OF PUBLIC, SUPPLIERS OR PRIVATE TRANSPORT.
